I also heard a lot of different things from some of my friends not sure if all of them are true or not. I have heard that people who did Labor substitution or converted from EB3 to EB2 are getting unusually high number of RFEs compared to others. Also DOL seems to be tightening up and scrutinizing EB2 applications vigorously(this is hear say don't take my word for this). Personally the one fact that I can vouch for from my experience with my family and vast circle of friends that did apply for Green cards is that people with a straight forward EB2 application had much higher chances of getting approved even with a later priorty date. I know four friends with a PD of June 2005 EB2(and many more with earlier PDs) from one retrogressed country who got green cards during that 1 month in July 2007 when all the dates were current. But I also have several friends who are either EB3 to EB2 conversion or EB3 with much earlier PDs (2002/2003) who unfortunately are still waiting for their I 485 approval even with an earlier PDs(most of them even did PERM Labor with transfer of PD or EB3 to EB2). many of them are still replying for RFE for one or the other issue. Does having a complicated application with EB3 to EB2 transfers/ Labor substitution delay the processing or lead to more scrutiny from USCIS? I don't know. I would like to know more from the other friends in the forum who have received RFE recently regarding their experiences. Also any straight forward EB2 filers who got RFEs please post your experience.

Know of a few cases from immigration.com where a bunch of envelope PERM filed were pulled in for audit when they saw that a similar case had been filed for lower category in the past. The cases subject to audit were asked to follow through and actually interview the applicants. Losing the job is a real possibility. Think u might still be able to find a few of these if you searchthere.
That said everything is risky in life.. u don't succeed unless u take risks.
Question : Why is PERM risky ? I thought that is the only way to get LC now.

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. These desi firms have sponsored people in EB-2 successfully. I have worked with these IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. Thanks.

Think of something that is unique, gets media attention, something that has not been done, but conveys the message in a very subtle way and yet is very powerful and will create a lump in the throat.
Free math turoring, free SAT preperation classes, you get the idea....
Good idea, do something constructive and get media attention. This solves multiple purposes, media attention, best use of time, and would also convey a positive message.

No. What I am saying is that this is a good amendment that can help us. But if its introduced and voted upon, it will fail to pass in the Senate because this amendment has a H1B exemption and H1B quota increases are very very unpopular and controvertial since last few years.
Therefore the achilles heel (Weak portion that will cause failure) of this good amendment is the H1B quota trick attached at the end. The amendment may pass the senate with a majority vote if it doesnt have H1B quota exemptions in it.

But from my observation , I think these bills get passed or failed based on lobbying (apart from legislators political considerations) , even though those provisions may not be fair to all. consider why a sweeping change like amnesty(what ever you name it) to illegals is being voted in, while legals are made to stand in line forever.
I think it will have better chances if H1 provisions are included because of a broader industry lobbyists that support H1 program. They do not support GC backlog elimination as much as they love getting more H1s.

Personally, I feel state chapters is a not-working concept. Having bigger chapters like TriState, Midwest... and better still 'East Coast chapter' is a face saver until we have sufficient numbers. There should we a minimum threshold say 40-50 [I'm keeping it low] members to sanction a state chapter.
I question why there should even be a MI chapter, when there are hardly 3-4 (am I exaggerating?) active members and the newsgroup is dead for all purposes? It's depressing and demotivating. We are better off in bigger regional groups until we have sufficient numbers to justify a chapter [ supply to follow demand, and not vice versa].
Right now, active members in not-so-active state chapters feel abandoned. They don't have an active chapter, and active chapters in other states don't want them ( go to your own). For e.g in there was no MI chapter, I would be a member of Midwest chapter or East Coast chapter, adding numbers to those.
State chapters were formed earlier. Then at NY, tikka came up with a brialliant idea of clubbing nearby states so that numbers rise. So we formed Tri State chapter.
We do have close to 80 people in the list and is growing, and PA members now have been able to revive their chapter.

I am on L1 Visa & I went to SSN office to apply SSN for my child (L-2 Visa). They refused to accept my application and they wanted Documentation from the appropriate government entity explaining the need for the SSN as per

Persons who sent their apps, now if they become curent in Oct, they will process those applications. And all others appls will be returned by Oct/Nov 2007 ?

I have always been of the opinioin, that the most correct thing for the USCIS to do at this point is to not return the applications, but hold them until Oct. When the window technically re-opens, just swallow everything that is on hold - the window technically only needs to open for a few seconds for that to happen.
The other thing they should also do is accept all 485 applications till the end of July and process them likewise.
Giving everyone EAD/AP benefits does not hurt....they can then line up all the 500-700K people and issue the green cards as per visa number/PD/RD availability...

As Chanakya is still getting rave reviews :) let me break this down a little more. OPs gripe can be broken into three categories:
1. What is IV doing with all the money collected.
2. What is IVs specific plans for the future/ what has it done in the past
3. Donor forum and general compliants about the concept
# 1. I think trusting IRS and CPA will go a long way. I am not aware of any donations being collected by IV on personal names. Have you sent any money to an individual and not IV the org ?
# 2. About us lists items that IV has done in the past. Do they meet your expectations ? Maybe yes or maybe no. What does advocacy mean ? For both the points, doing some research will help. Why we did not have stellar succeses with past campaigns ? Advocacy, how quickly can we be successful. Google and find out.

I don't like getting my ass kicked. Hence, I refuse to fly Air India.
Last time I flew that Airline (Boston - Heathrow - Mumbai):
1. The crew disembarked at Heathrow. The transit passengers were not allowed to disembark.
2. The crew shut off the heat/power and opened the Aircraft doors (yes, it was winter).
3. They sent the cleaning staff in to clean/vaccum the plane with a lot of passengers seated.
4. At Mumbai, the airhostess was in some sort of a hurry shoving the passengers so that she could disembark first.
I've never had such experiences with AF. They are not racist. Airlines are not allowed to issue transit visas and anyone who has lived in France can tell you how insensitive and lazy their bureaucracy is.
Bad flying experiences do not equate to racism. It is strong word to use and I do not think it applies to this case. Yes, I have seen French show racism towards Africans, but this is not one such case.
There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.
