Something can happen if we have a Democrat Congress which is filibuster-proof, meaning > 60% of total membership must be Democrats, AND a Democrat President, then something good could happen for us. It might not be exactly what we like because "undocumented" will get the same as well, but atleast also get what we want.
Nothing good will happen for us if we have a Republican Congress and Republican President. They will just make life hard for all of us --legal or undocumented alike. If we are having a hard-time getting a Driver's License right now, then expect worse if this combination happens next year plus the continuing recession.
Republican Congress + Republican President + Recession = NIGHTMARE FOR IMMIGRANTS
They will put all the blame on us, which is already happening right now.

I recently talked with my lawyer and also took consulting (paid $$$ for hourly consulting) with another lawyer as I am going thru the same route. Both the attorney mentioned there was no problem doing ac21 for H1 while AOS was pending for > 180 days and 140 approved .

There are total 27 EB3-I approvals on since Oct'2008. In 6 months, only 27 approvals is not a good number.
Does anybody know why USCIS is not touching EB3-I aggressively and are we close to using all EB3-I for this year already?

As mentioned by some others in the same thread: a lot of employers are also taking advantage of this situation.
i was one of those who was forced to file EB3 despite qualifying very well for EB2. The pretext is job description, although same job description has personnel applied for in EB2.
Quite a few of the EB3 crowd has had no choice, but to be herded in the slowest category to benefit the employer.
How can we highlight this?
Only way out is to find another employer/manager, file an EB2 labor and recapture the old priority date. Once you have the basic qualifications (MS or BS+5), the decision between EB3/EB2 is subjective and at your manager's/employer's discretion.

You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.

aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.
the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . and i see here a comment that every campaign has been bad for EB3 india.

It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

Folks, don't make travel plans based on the approval e-mail that will be sent of automatically from USCIS. Mine & my wife's application's were approved and mailed nine days ago (6/18) and we made travel plans for yesterday (6/26) . Guess what. I got my approval notice in mail only yesterday and my wife's approval doc never came. We have to cancel the whole trip now.
Also, USCIS updated the status on our AP's four days later after the approval e-mail was sent saying the documents were mailed only on 6/22. Called the USCIS customer service three times and I got three different answers.
1. We sent approval notice on 6/18 and will be sending the AP document soon (In fact there is no such thing called approval notice and AP separately. This guy has no idea what he is talking about at the USCIS)
2. We sent the approval notice on 6/18 and confirmed that the document is out in the mail where in fact the document I received yesterday had a USPS stamping day of 6/22.
3. We sent the document on 6/22 and you should be gettting them in less than 30 days. If not please give us a call back.
Lesson learned. Don't trust USCIS and USPS delivery system and don't make travel plans unless you have all the doc's in hand.

i too worry that for a simple issues such as visa recapture the media (dobbs) and the zelots (num usa etc.) create such a stink wonder if any CIR related reform will ever pass. We are tiny spec in immigration reform and will keep suffering because of the larger concerns. My congressman always talks about supporting legals and skilled immigrant, but when we asked him to co sponsor this bill, his staff kept waffling.
You said you dont want to get into the discussion on who is better and yet by explicitly mentioning who you think is better, it seems discussion is started :D Being a Friday evening - work slow and I cant help but jump in :)
American presidential politics are highly media driven. When I came to this country and started following politics closely (12+ years ago), initially I was fascinated by all the discussions and transparent process etc. But over the years got convinced that its all a facade - election process here is as much flawed as in a "third world" country. Election 2000 is the biggest proof. Even worse, here people are easily swayed by non-issues. Media creates hype and media creates perceptions about a candidate, real issues and concerns takes back seat most of the times. Just see now - for last couple weeks everyone is talking about a VP candidate - the power of a VP is limited but yet everyone is talking about her and almost forgot the presidential candidate of the same party. The republican favoring press wants to project her as the next savior (which unfortunately seems to be working) and whip up their cadre. The democratic favoring press wants to project her apparent inexperience etc. We may soon see who is going to win in their "spin". In general republicans are pretty good in spin stories and project an apparently dumb candidate as someone with "whom you can have a beer with" and get him elected; now they might even succeed in projecting a 30+ year senator who backs current administration as an agent of change !!?!!! and people might even fall for that argument. Of course there are spin stories on the other side too.
Anyways, whoever wins this time - I think our situation wont change much and might even get worse. As the economy get worse - it would be very difficult to get any new bill favoring us (note I am talking about EB green cards not H1B). There is already a good effort by likes of numbersusa and programmers guild to project HR5882 as if it will kills jobs. As we know HR5882 is only for recapturing unused greencards the beneficiaries of which are mostly in this country already. It should have been a completely non-controversial bill - if we can see the resistance its facing we can imagine about any other bill that propose increase of GC numbers or something such. So prospects for anything better happening is very poor irrespective of who the next president is - that's my reading on this.

By waiting you are doing the same mistake that I did last year. My AC21 RFE was mailed to my previous employer's attorney. They promptly mailed it to me. But I did not get it for one month. In the mean while my priority date became current and I thought that attorney was playing games with me.
After waiting for one month I went to my post office and lodged a written complaint. In two hours the notice popped up in my mail box.
What had happened was that the mail man had simply delivered the notice in mail box 5617 instead of 5616 and no one was living in apartment 5617 and no one picked it up.
By the way, with that much delay I missed the 2007 bus.
My attorney called them and requested the copy of Denial notice as well as asked them for faxing it.
Still not received anything.
Not sure what to do except waiting.
Irony is that all notice reaches on time except denial notice. Seems like they are trying to eliminate backlog by doing some tricks

(2) If you are working, you may want privacy. Step out of the office for a 10 min break with your cell phone
(3) Go to a calm place - could be a garden or a lobby or a rest area or a parking lot or inside your car.

(6) There is a person on the other side who is very much human like you
(7) This person is a staff and is doing his/her duty.
(8) Speak out clearly - have a pleasant conversation

Most likely the CIS "immigrants" were ex-undocumenteds who got "Amnenstied" in 1986. What ancedote will they use? How they broke the Immigration laws back then?
I wouldn't be surprised if it turns out than some of them were former "Grand Dragons" at triple-K! Not revealing the past is an indicator of closet full of nasty skeletons.
thanks wd - I was looking for the comarata dude - & borgas who is apparently an immigrant himself. something like - what shaped their views and informs their opinions - they are extremely passionate and effective and dont hesitate to use personal anecdotes but never from their own life
