I would expect a minimal level of service from an expensive lawyer whether my company or my wife's company or I myself pay for it. We are their client. That is what they do not understand.
Can you believe they took 10 days to inform us what docs we need to provide for the 485 filing even after the fact that we had called them the day in June when the priority dates became current. Even in the list of documents, they had "Certified Birth Certificate" and when we asked how do we get Certified, they were like oh just give a photocopy. We had already spent 3 days researching about this CERTIFIED BIRTH CERT. The certified concept is something which is not common in India but it is in USA and a company like Fragomen should know this - it is their job.
Even after HR's multiple emails approving to start the filing 15 days later they ask us if HR has approved this - RIDICULOUS.
We asked them for the copies of the filed petition, they took 1 month to provide them as they were TOO busy filing other applicants - fine but making copies and sending over should not take more than 20 mins.
Now, I have been asking for a receipt for the money I paid out of my pocket so that I can get it reimbursed from my employer, they are giving me a hard time.
All I expect is when we are paying so much money - they should provide services to us.

just fyi...it took fragomen 6 months just to start the recuitment process ...they are really slow. but they are quick in getting back to you on your day to day requests.
My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

The numbers game is really a 6 of one, half a dozen of the other - since we can only best guess it all - as I think this healthy debate has shown!

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.

If this government doesn't wake up and solve this problem in a year or so, I don't think, this country deserves me, or for that matter any graduate degree holder.
Better off utlizing the skills I have acquired here, and spending my next 5-10 years contributing to India's economy. Maybe start a company or something...create jobs out there, and then as and when the laws straighten and America becomes welcoming to EB talent, think of coming back (if ever....)

Alias, very helpful guidance. I plan to take this up with my attorney and see if I can correct the error. Can you let me know which attorney firm worked for you? It feels frustrating that now I need to spend money on an attorney and go through all the stress for correcting the mistake probably made by a USCIS staff.
To the question from urwelcome, I don't think I received a I-485 approval notice. As far as I know, I had the biometrics, then an RFE and then a Welcome Notice in January. I have never received the actual card as in the case of Alias and my spouse's status remains unchanged. I am on EB3 (India) and the PD is August 2003.( don't have the exact date on top of my mind, it has been a long time:-))

I just got off the phone with some lawyers on this. It looks like a strong case so far. They will be discussing it with their director and possibly getting some other law firms or organizations involved. That is all I can say for now. I will update you when I know more.

They have to do those work anyway. Because all the applications are not I-485 and also some ppl filed I-140 along with I-485. So, they do have to repackage those applications. Let us see,how events develops for couple of more days?.

What we get
1. We get number of EB2,EB3 Primary and EB2,EB3 Dependent applications.
2. From the wordings, I won't be suprized if they give a summarized number from 2001.
But if someone else requested this info broken into PD buckets by month and Year, then I think we need to use that. The letter I sent had that wording, but I never received any response yet.
Here is what we don't get
1. Break up by country - Helps folks in EB3 as ROW is not current
2. Some might have not applied for AOS for various reason like their I140 is still pending, Some companies mandate that. - This could be a small percentage
3. Break-up by PD month& year
More insight is welcome.. Pre-adjudicated cases are not approved cases. So they can't eliminate them..

Its funny they are asking me to define priority date ! :)

I have tried to convince people (Indians and some Chinese) to join IV. People don't. They don't believe IV has the capability to get anything done. A lot of people don't care if IV existed or not. They all happen, mostly on their own. IV's role is to add amendments when they come and remove provisions that hurt us. We did that successfully last year by getting the hard country cap removed. No one else was interested in removing the hard cap. It took a lot of co-ordination and lot of trips and lot of hard work to get it done. If that harmful provision had stayed, then the new quota of 650,000 in S 2611 would have been useless. People forget achivements of IV or think that it was negligible. Retrogression would have been exacerbated with hard country cap.

I am not a leader and I don't want to pretend that I am. I ask others who are not to step down and encourage the right people to take leadership positions.
That's what it seemed from your original post. And nothing wrong with that. If you are up to the job then you are welcome. We already have state-chapters and people are not actively participating in that. Last week, on California's state chapter conf call, 2 people came. If you take leadership, you need to do things locally like meeting with other people in your city, forming a group of 4-5 people and going and meeting your congressman. And if you want to be in IV core, then you have to call us on the phone number listed and we can see if you can add any value to core by doing things we routinely do, like content prep, website maint, travelling to DC for meetings, talking to other orgs etc. If you are up to the job, sure, why not. Anyone who considers themselves fit for IV core, please call us. We really do need help as we are overwhelmed.
I am a very dissatisfied member of IV. Are you satisfied with IV so far? Why doesn't everyone raise these questions? What has caused us to fail so far?
I am dissatisfied too with the results. Its not like I am a happy camper on H1. What has caused us to fail? The same thing that has caused us to fail last year, the same thing that caused industry to fail in getting H1 quota raised, the same thing that caused failure of Universities to get F4 visa for masters degree holders. And these guys have lobbying budget in millions? Why do you think they failed?
Whatever caused their failure, caused our failure too. In DC, issues are not debated and legislated based on morality and merits of those issues. They are taken up based on contemporary politics and other factors like lobbying, public attention, elections and political parties.
For example: Last year, they debated a constitutional amendment to ban flag burned in USA. And spent precious time of congress on debating it. How to you think that would have helped anyone? Even it had passed, what was the merit of the issue? Flag burned mostly happens outside USA. In USA people rarely burn US flags. So banning flag burning in USA is like banning metric system. Its meaningless. Yet, they spent time on it.
Read papers, read articles from other lobbying orgs and learn something. Legislations dont happen on their own because the issues carry weight and have merits. Merits have nothing to do with congressional action.
To quote a bestselling economist Steven Levitt :
"If morality is how we would like the world to work, economy is how the world actually works".

I am not a leader and I don't want to pretend that I am. I ask others who are not to step down and encourage the right people to take leadership positions.
That's what it seemed from your original post. And nothing wrong with that. If you are up to the job then you are welcome. We already have state-chapters and people are not actively participating in that. Last week, on California's state chapter conf call, 2 people came. If you take leadership, you need to do things locally like meeting with other people in your city, forming a group of 4-5 people and going and meeting your congressman. And if you want to be in IV core, then you have to call us on the phone number listed and we can see if you can add any value to core by doing things we routinely do, like content prep, website maint, travelling to DC for meetings, talking to other orgs etc. If you are up to the job, sure, why not. Anyone who considers themselves fit for IV core, please call us. We really do need help as we are overwhelmed.
I am a very dissatisfied member of IV. Are you satisfied with IV so far? Why doesn't everyone raise these questions? What has caused us to fail so far?
I am dissatisfied too with the results. Its not like I am a happy camper on H1. What has caused us to fail? The same thing that has caused us to fail last year, the same thing that caused industry to fail in getting H1 quota raised, the same thing that caused failure of Universities to get F4 visa for masters degree holders. And these guys have lobbying budget in millions? Why do you think they failed?
Whatever caused their failure, caused our failure too. In DC, issues are not debated and legislated based on morality and merits of those issues. They are taken up based on contemporary politics and other factors like lobbying, public attention, elections and political parties.
For example: Last year, they debated a constitutional amendment to ban flag burned in USA. And spent precious time of congress on debating it. How to you think that would have helped anyone? Even it had passed, what was the merit of the issue? Flag burned mostly happens outside USA. In USA people rarely burn US flags. So banning flag burning in USA is like banning metric system. Its meaningless. Yet, they spent time on it.
Read papers, read articles from other lobbying orgs and learn something. Legislations dont happen on their own because the issues carry weight and have merits. Merits have nothing to do with congressional action.
To quote a bestselling economist Steven Levitt :
"If morality is how we would like the world to work, economy is how the world actually works".
Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.

I and my wife got our approved EADs in our hand in 17 days (Mailing day to USCIS to recevied date by us). Only strange thing is that my EAD is valid from 06/2008 to 06/2009. I thought the new EADs validity would begin when the existing expires. My existing EAD expires on 09/19/2008. I lost 3 months with this renewal.
USCIS has been unfair in renewing EAD.
What about writing a letter to them? - by grace of God, if they do realize, they may give properly - for 2 years.
