I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.
Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

1. I am working on H1B for "X" company and they have filed extension for it. Now, I got an offer from "Y" company and they are willing to transfer my H1B.
Is there any problem for H1B transfer to the Y company while it is filed for extension from my current employer?
2. The new company "Y" is also going to file my new GC labor and I-140 as job has little different and senior role but similar to what I had in my previous H1B and GC labor in EB2 category.
Now, can my current employer "X" company remove I-140 or create any kind of problem for my immigration status, specially with GC?

I had my tests done on Monday, X-Ray on Wednesday and my paperwork is ready today (Friday). All in all, it took about a week. Don't know about other doctors....this is in Milwaukee, WI.

Dear Adviser,
I am end of my 6th year of H1B and my current employer filed H1B extension using my approved I-140 (and I don't have EAD). However my employer took the advantage of my immigration status and reduced my salary drastically . I am planning to change my employer after I receive my H1B extension. Now I have following questions
1. If I accept new job with other employer and transfer my H1B to new employer, by what time (months, years..) my new employer has to file PERM to continue my GC process?
2. What if my current employer cancels my I-140 when I moved to new employer? Still can I use that I-140 to port my priority date to new employer?
I can plan my future employment based on your response. Thanks for your time.

Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.
My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

Does anyone know if a H1B can be transferred from a University to a company? Has anyone gone through this process?
The present h1 position comes under university (non-profit) category. You cannot transfer your H1 to a company which falls under profitable category. You need to apply for a new H1 which falls under cap.

I have returned today from india
The immigration at DTW airport gave me a tough time
They were not happy about the fact that i Canadian green card
They advice me to surrened it and said it does not satisfy the US and does not not convince them that a person is trying to adjust status and holding a canadian green card
He said he made notes and will keep an eye on my case and adviced me 2nd time to surrender the card and keep paperwork for proof to prove the US authorities
I Have travelled at least 6 times on Advance parole and always had Canadian Immigration stamp on my passport (i have not travelled to canada after getting my Pr card in Oct 2008)
Pls advice

Your help on the matter is appreciated. I am EB3-I. I filed for I-485 in July-07. I have been working on H1. Now I am going to switch to EAD by AC21. My new job has same job title and job duties. They have another condition for job. I will have to have a Masters in 8 years of starting my job.Their basic requirement is still Bachelors but Masters condition is kind of extra condition. My question is does this give me any trouble for my GC process because of Masters condition.Another question is will I be able to switch to EB2 based on this.

Hello,
I am a canadian of Indian Origin.I was granted US Immigrant visa under the EB3 category at the Montreal US consulate in 2004.At that time I could not take my family for the interview and we chose to take their Visa later.after 5 years now we have decided to move to US (I am on commuters GC now) and has been trying for an appointment for my family at the consulate in Montreal.The consulate has informed me couple months back that there is no visa number available and my priority date is also not current (our priority date is Mar 2002).Is there any way out of this as I read now that the priority date is stuck in 2001 for a few years now and there is no real chance of moving ahead any time soon.I realise now that maybe we should all have taken the visa at that time instead of just me.Now I am stuck , is there no special case for my type of case as I had already been granted Visa earlier or since My case was already approved in 2004? I will appreciate any help or advise.

Hi,
My friend had done 7th Yr Extension last month. By Mistake she gave dates such that it showed that she was out of USA for 1 year. So the lawyer filed for 3 yr extension and USCIS permitted. Is this rectifiable?

Below is a link I came across which is easy set up, formatted already for users to input their personal information and off it goes to the Congress to educate them about the importance of travel industry and meetings market. Is their anyway we can come up with something similar and easy to use so our users that do not get on the bandwagon at times just because of the extra work that goes in to it can also contribute?
