I was wondering about DOL letter which my employer received yesterday..for Recruitment process for 30 days..I wanted to know is it because of the conversion we did to RIR process some days back or is it just that they caught up with my TR application after 5 years..TR-Oct 2001

Is it possible for a resident of Pune to apply for a tourist visa at the Hyderabad consulate? The Mumbai consulate doesn't seem to have any openings online, so not sure how to make an appt with the Mumbai consulate..

Depends on what is written in your LC job requirements. If it is either Masters or BS + 5 yrs of experience, then - yes, you can file I140 in EB2.
Otherwise, you will have to file a new labor.

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

My current h-1 B visa in passport expires May 1, 2007. And I have a I-94 valid till May 1, 2007. I already got 3 yr h-1 b extension valid from May 2, 2007. I have to travel to canada in March and I am planning to get the new H-1B visa stamping when I am there instead of making another trip.
Is it possible to go for visa stamping for the extension h-1b, when the intial
H-1B visa is still valid. My understanding is if the visa is issued, all the previous visas will be cancelled. In that case, Can I re-enter US in March with a H-1B valid only from May, 2007

i am in a small problem and it would be great if someone could help me out.
i came in us on f1 visa in jan2008 and i completed my mba in dec 2010. my opt expired on 31st march 2010. but before my SEVIS could expire i transfered my SEVIES to new college for summer term. now my visa is for 5 years ending on jan 2013. i know as long as i stay in US i am maintaining my status. but now i need to go home for few days. So how is it going to wrok for me? Do i need to go for new visa stamping or can i come back on same visa ? if i need to get new visa can i get it done in US before going home ? What are my option and what are my chances of coming back?

Required Qualifications
A Bachelor's degree or equivalent training in Business Administration, Health Service Administration, Mathematics, Project Management or Industrial Engineering.
Five or more years of progressive experience in an exempt-level business analyst, project management or process improvement role.
My question to you is whether this job requirement classify this job in EB 2 category? Thanks.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

this is a bit different maybe since it deals with my mom. She was sponsored by my sister. She has been stuck in name check now for about 18 monts. Anyways, she is out of the country. She just left, and now my sister got a letter and appoinment letter for a 2nd finger print. My mother is using her advacne parole and the green card was filed for adjustment of status.
so the questiong is can my sister reschedule the appointment 8 months in the future or can she change the location for finger print to the office in the country where my mother is,
She is in Pakistan right now.

I left my Indian consulting company and the employer owes me $14,000 which he is now refusing to pay, he says he will deduct it as a cost of H1 and GC processing fees
When I started working for him he told me that he would take care of all these costs(of course he did not give this in writing) and not at anytime was there a verbal or written agreement that I would have to repay him these costs if I left him.
What recourse do I have now?

I am applying to renew my EAD and looking at the paper Application on page 7 I see that if you are C9 which all of us are mostly..we need not file an application fee..
