Hi I am currently working as a contractor at a client from company C1
C1 applied for my H1B last year and application is still pending + also added Premium Proc. last week, Application Still Pending
At the same time company C2 applied my H1B last year and H1B approved but did not get the documents from USCIS, and applied for "Response on Approved Petition", That is still pennding(But Yes The petition is approved)
But Fortunately or Unfortunately , I got a permananent job with a new company.
I can start working with that company on OPT, and he will apply a new H1B this year.
But , Instead of that Can I get one of my H1Bs transferred?
Or is there a better way to handle this situation?
I know its a mess... Can some one suggest me how to clear this mess?

This is purely my opinion and may not be the best legal advice. If I were in the same situation, I would go by the EB type (EB2 first) and then by the priority dates. Whichever one is higher, I would apply both in that classification. If both I-140's are EB3 and same priority dates, I would go with the one with better job security (stable employer and job) and keep the other I-140 as backup. In this day and age of corporate acquisitions, mergers and bankruptcies and USCIS backlogs, you want to use the option with the least risk.

I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

If any one is a client of Cohen and Grisby and looking to appliy AOS now, have you heard anything from them asking for forms and docuements or when they will start submitting the applications.
I looked at their website and they haven't posted a thing, nor have they sent an e-mail, like they sent after the first July bulletin came out in June.
I was wondering if any one is in same situation as I am. By the way I already tried to reach them, but could not get through.

You should get to talk to USCIS coz this is wrong for sure......USCIS should issue you a new EAD with no additional cost.........Even if you do not plan to use EAD card get the issue fixed.......

This is probably a silly question but I have this really nice logo
designed in photoshop that I want to use in flash but the problem is that everytime that I import this picture to flash I get that white background the picture was saved with.
Does ANYBODY know how to get rid of this background so that I can just use the logo?

They can pay you in anything they like for immigration purposes. US immigration doesn't care what you get paid when you're outside the US.

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

My married daughter from India currently on visitor visa has been here to visit us. Would like to seek extension of her visa by 4-5 months so that she can spend little more time with us. All her immediate family members are in USA and with extended approved stay she can visit all family members and spend more time with old parents. She has 10-year visa given to her in December 2008 when she came for the first time after this visa. Her husband and children are in India.

I am an Indian citizen and a Permanent Resident of Canada. My Fiance is a US Citizen and we're planning to settle down soon. I also have a valid 10 year US B1/B2 Visa.
I know that if one marries a US Citizen you can get US Green Card but I am not sure about the processes. I want to know what is the best procedure so that I can be in the US quickly and also have my green card.
I know there is something known as Fiance visa but I'm not sure how it works.
Can anyone please elaborate and guide me into this situation.
