I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.

There should be a option to modify the the Application. I guess you can't modify PassportNo, Name etc.. But you can modify education details.

Program is the name of your main application's class itself. What I am doing is creating an instance of my application and using the two methods that live inside that class.

I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

eFiling EAD will result in ASC appointment for code 2 biometics (Finger Printing of right Index finger + photo). You need to take the appointment letter and one form of photo id (passport or drivers id).
I had my ASC apt. for eFiled EAD last week (Feb. 12th).

what is the best way to do a change of address with uscis for pending applications ? I tried online changing ar-11 and for each individual case nothing seems to be getting in effect, my FP notice still gets forwarded to the old address. I also even called the uscis customer service and changed it , still no luck. any one had similar experiences ? please advise on what to do .

I am working on H1b visa and changed job mid of last year. I got my H1B visa and stamping and is valid till September 2010 . Now I changed my job and has another H1b visa and I 94 which is valid till 2012.
I am going to Canada to get Visa stamped and want to know if I will be allowed to come back to US even if my request gets denied.
And what will happen to my old visa ?

It is safe to apply for N-400 after 90 days prior to 5 years and your wife can wait and apply in another couple of months.

Valid AP is enough to travel - no one should care about your EAD if you are entering based on your AP. Ofcourse, always carry a copy of the I-485 and your wife can say that you are the primary applicant if they ask for her work status, etc...
Traveling with an AP (w/o EAD) should not be an issue. Good luck!

Hello,
I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

Can some one file for H1 transfer when his/her H1 extension is pending?
Also there is a RFE on H1 extension which the company is responding.
Original H1 expired 2 months back but have a valid I-94 till december.
Used AP to re-enter so I-94 has Parolee status.
please advise.

Hi,
We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

I am silent visitor of this forum for last few months though, I seek some advice form you guys in forum. I just got I140(On May 5th 2008) approved and my priority date 23rd Jan 2004. As per the visa current bulletin I am with in the cutoff dates. I have job offer but I did not accept so far because I 140 was not approved but after I 140 I thought of changing the job (same offer) using AC21 portability, since I fall in current cutoff dates,
My question is this safe to change the job when priority date fall with in current cutoff dates?

The Congressional Hispanic Caucus has sent a letter to the President asking him to terminate the controversial 287(g) program that allows local police to enforce immigration laws on behalf of the Department of Homeland Security. The CHC expressed its concerns about allegations of serious civil rights violations against Hispanics as well as recent reports of poor oversight in the program. The National Council of La Raza, the country's largest Latino civil rights organization praised the letter.

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why?
