How we are getting 50k is like this.
1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
3) EB2 India has quota of 3500.

I disagree. I would expect a person to convey that they are not officially open despite the doors being open. I agree its not nice on customers part to enter before the office is officially open, but that does not mean the officer just threatens a countryman.
We should learn to respect our countrymen/women first. If I were to try to enter a business which is closed but doors are open, I can tell that someone would tell me that same verbally!
You took the words out of my mouth dude.. Lack of respect for fellow indians is something that I have noticed on several situations when I try to make friends with people especially Indians. Some, take things for granted.
Now I cannot blame them as people's behavior is driven by past experiences with fellows.. may be they suspect every other person as one of those pyramid schemes guys.. not sure.. I am far far away from those things though.
I have to tell you one thing, when ever I smiled at folks, they did return one except few who look the other way.. don't worry..keep smiling guys.. after all it costs nothing..

We need to do something for sure. I know that most of EB3 folks are stuck for GC more than 7-8 years. I don't see any good progress for EB3 in the future.

Simple and yet we have not acted purposefully. I have a strong feeling that this visa grab is still going on. HLG has sent out another immigration alert to all registered emails, similar to one posted on Feb 9, 2007. . And I quote a bit

Indebted to our employers for anything or in any form. We work and get paid for it - it's an even exchange, imo.
How long will it take them to lay you off tomorrow morning (or Monday morning or on X'mas/Diwali eve for that matter) if they didn't need you?
And vacation time, if part of the employment package, is a legal obligation of the employer - you can hold their feet to the fire for that and if you end up not taking any vacation you are entitled to compensation for the extra time worked when you leave.
These are the lines of thought that should prompt one to join IV and be involved with it .

Having time off with my boss is traumatic to say the least. I am entitled to seven weeks vacation a year and barely get three most of the time. Even when I am off I get phone calls and have to leave contact numbers, that includes when I am with my parents in England.
Can you imagine asking for two days off to go to an immigration rally that just reminds him that I will be out of his employment jail some time in the not too distant future I hope.
My green card process is in its sixth year. Look forward to shaking off my shackles and moving on with life. Glad to say my husband now has an EAD so at least he is free to work and join the human race again.
I am sure many people are in this sort of situation since we are indebted to our employers which is one of the things we would like to change.

i think it's not quite that simple.
there is no doubt that lack of numbers is a key key issue. but letting uscis off the hook when they have failed to process 269,000 Green Card numbers since 1994 is not kosher. that is >20% of the backlog right there.
my straightforward NIW application based on national interest service not exceptional ability (which may be more subjective) will take almost a year to process. wow....!
uscis also takes the narrowest interpretations of any law- even when it clearly conflicts with the law's intent- then it takes a lawsuit to budge them- speaking from personal experience and the loss of 4 years in PD in an India line...believe me this is not an agency i feel like defending.

Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.
Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.

Do you really think the numbers will be that bad? Look at the improvement in turnout in DC from San Jose? Every movement political or not builds gradually. The idea is to make it easy for people to show up rather than ridicule them for not showing up.
We asked people to show up at the rally giving up (1) A day�s pay ($400 to 1000) (2) Spend money on travel where ever the buses were not available ($$) (3) Spend time away from home. That�s a little difficult for people who have not seen a single person from IV yet (which is most of us). On the other hand many people who attended the rally in San Jose did not mind traveling all the way to DC�Can you think why? Do you think Indian�s in CA have a different mindset compared to those in TX or NY/NJ?
IMHO, we need to do more work at grass root level. If rallies are local and on a weekend then more people will turn out. Not only will there be better turnout, many of these same people will being more passionate about their support to IV and might start showing up in out of state rallies and protests.
Many of my colleagues did not even know until yesterday when I showed then the news articles that there was a rally like this in DC. Unless we have local chapters with an organized structure which meet regularly/ even if it�s a conference call, you cannot expect mass mobilization�this is Politics works!!
I think the DC rally has caught every ones attention, this is the right time to push the drive for local mobilization, it will be tragic if we lose the momentum now.

Hello guys!
I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.
I would give some days to Attendees and particularly to IV core team to analyze the rally events, meetings in their entirty and come up with the conclusions mainly for 3 things. And I request everybody to funnel data to core team centrally and the same way conclusion and future action list funnelled to members.
- What we could REALLY achieve
- How loud we could be heard
- Any potential and positive impact in near future?
- Based on all of above making near future strategy
Note: One thing I want to bring everybody's attention that from November Elections will slowly be given priority by every media and so we may have to come up with careful strategy not having any conflict with election realted major events.

There is nothing really called transfer. When you are filing for the first time its counted against the cap. Otherwise its not. So when you are transfering the H1

They have to abolish the H1B programme completely since they can no longer prevent its abuse. They need to have a new process in place in which scrutiny occurs for each application of a foreign worker!
Another option is to spread the words how Americans treat H1B workers, esp. those educated ones. Once a realistic view about coming to America as a legal foreign worker is known, I bet a lot of people will not come. Who is going to waste 10 years of their life living in a "near-slave" work environment and at the end still apply to Canadian residency? :D
Once nobody, esp. those well-educated, high-tech, skill workers, comes, they will see the impact of the whole American immigration saga. ;)

Also note, the attendance at short notice for the SJ rally was phenomenal.
Let's just say Californians are more motivated and active then many from the DC area, and you can expect an even larger crowd the next time around, with better planning and more time imo.

There are many not so preferred areas in Canada, where there is always a demand. Most people prefer large cities such as Toronto, Calgary, Edmonton, Vancouver, etc. These are mostly saturated, but with persistence you should find something even there. If you don't care where you live, you should definitely find a lot of openings in the area you mentioned.

But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me. But as long as IV keeps on harping that they represent the plight of legal immigrants (which I am) then I do have the right to ask the question ..."What exactly has IV done?" .
