    I would be really surprised if they are not rude and customer friendly. Its the curse of Indian Govt employe's attitude. No matter where they go...they can not change. Most of the time their service is pathetic,rude and unfriendly. Unfortunately they are representing india to all over the world.

    Guys, temper your expectations. Cust Service Rep at USCIS are not trained to answer the questions that pertain to things like visa bulletin's effective date and whether or not they will accept the ones or reject the ones on July 2.

    Cust Service Rep is for general information for those who cant or wont use the USCIS website and other sources of information on the internet. Or for those who dont speak English.

    Cust Service is not intended to provide complex answers. Last I heard, even the Vermont service center folks didnt know about bulletin revision and they were turning down 3-year extension requests for H1 visas thinking that the bulletin is current until confronted by lawyers who said that bulletin is unavailable and now there is reason to give out 3 year extensions instead of 1 year extensions.

    If Vermont service center was unaware of visa bulletin revision, then what do you expect from a Cust Service Rep who is trained to answer questions that cover information that can be fit in 20 pages ??????

    First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

    Chapter meetups is a positive step. The so called baby step.... If folks RSVP and do not show up, the leaders will get upset if the same folks do not have the courtesy to tell why they did not show up....;)

    Folks, I got the response from AF.
    This is what I sent them:
    Your message............................ : I would never ever fly Air France, because I am a resident of India and your Airline treat Indians very badly, discriminating because of the country of citizenship and color. Shame on you for making 55 Indians wait in the airport for more then 12 hrs while the rest of passengers (non-indians) were arranged to go and stay in a hotel. Shame on you for ill treating the passengers in your Country (Paris, France). 1 less customer for you Air France!!! My suggestion: Change your attitude. Don't give substandard treatment to non-white passengers.

    Dear Mr -------,

    Thank you for your message. On behalf of Air France, I apologize for any difficulties caused by this unfortunate incident.

    Flight AF 218 from Paris to Bombay, operated by an Airbus A330 with 169 passengers and 12 crew members on board, left Paris-Charles de Gaulle airport at 12:45 on 10th May and returned at 20:06 on the 10th of May, as while en-route the pilots noticed some vibrations from the Cargo hold, which could not be checked during the flight.

    At Paris-Charles de Gaulle, under the supervision of competent authorities, checks were carried out on the technical state of the aircraft but no abnormalities were found.

    Passengers with a valid transit visa were put up at nearby hotels for the night. Also despite the fact that transit visa�s are issued by the immigration authorities, Air France staff mediated the issuance of visa�s which turned out to be a time consuming process. Needless to say passengers were taken care of by the Air France ground staff who spoke fluent English and passengers were also provided with food and water.

    All the passengers were transferred to another Air France aircraft the next day, flight AF 218A which left Paris-Charles de Gaulle at 14:15 and reached Mumbai safely. Air France regrets any and all inconvenience caused to the passengers due to this incident. At all times, the main concern of Air France is to ensure the security of passenger.

    I do hope that the above explanation will help soften the negative impact of this situation and hope to have the privilege of welcoming you aboard Air France in the future, to your entire satisfaction.

    I have filed my I-140 through company A and waiting for approval but now I want to get my H1-transfer to non-profit organization(company B). Can I do my H1 transfer to company B and keep my Green card process continue with company A. Also this company B is paying less salary then company A , will this effect my I-485
    Also how safe it is to transfer H1 from profit to non-profit organization. What if tommorrow I want to get H1 transfer back to profit organization.
    Some people say that H1 transfer for profit organizations fall under H1 transfer cap. Is this true?


    My wife is currently with Employer A on her 7th year H-1B which is valid till Sep 2009. She also has her approved labor cert and I-140 from this employer, but decided to continue on my I-485 application. The I-140 however is still valid.

    She now wants to change jobs to Employer B using H1 visa transfer. I am guessing she will need to include a copy of approved I-140 with her H1B transfer application. But Employer A is not providing us a copy of the I-140 approval.

    Can someone please advise what we can do in this situation? Is a copy of I-140 critical in this situation? Or just a copy of online approved status will be sufficient? Any other ideas?

    I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??

    3 years experience period. It is an add on to the point system, if at all the amendment passes. At that point, there would not be any of the labor-140-485 process. You will be exempt from visa numbers, who knows what that system would be.

    Hi,
    1. I filed for my I-485 in July 2007 with the old fee. This included AP & EAD
    2. AP and EAD were renewed in 2008 Sept, with new fee for both of these
    3. AP is up for renewal, so is it free for me,or do I need to pay $305 again?

    My question arises, since I assumed that the "free renewal" is for anyone who pays the new fee "once" for the EAD/AP.

    Anyone who knows about this thing?

    Politics makes strange bedfellows and while anti-immigrants band together they donot have any additional support from other groups (I maybe wrong and IEEE and Programmers guild may be joining them). On the other hand we do have support from industry even though they primarily support H1B increase. Suffice it to say that we play a very important part because we are the grassroots part of the whole industry lobbying machine where the industry lobbyist can show that the affected parties are in support of what they are saying.

    The problem of contacting media with "stories" is that you don't want people who are just hanging by a thread; just trying to stay in status and having all sorts of hardship because they want to stay. It feeds into the fact that there are a lot of people here which the country doesn't need. Discussing layoffs or threats of layoffs or employer abusing, etc., feeds into the perception from an outside person that there are too many people here not doing specialized work that an American is not able to do.


    In fact this is a very valid point ..... We should be careful about what kind of stories we diseminate into media .... If we are just giving stories in which people apperear to be grovelling to stay on at whatever cost is not good for us as I think...

    Updates:

    The updates are provided periodically on forums from IV core. We are currently working on the House side for pushing SKIL forward. There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.

    We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.

    We try not to restrict free voice and opinion from members on forums however, if it gets downright nasty we will edit posts and censor. But in principle we try to avoid it as much as possible.

    If you have questions, and if you think that IV core is not up to the job and needs help or needs to pace up, or if you think you have questions for IV core, please pick up the phone and call the 281 number listed on the website's "Contact Us" and call us. We will answer ALL your questions as to what we are doing.

    That would be much more productive way of finding answers to your questions.

    Hey Risker,

    It is a FACT that you/your class is more agrieved than any other possible class. But we need to be high on intellect and low on emotions. There is reason to wait till SEP. Besides although I am not sure but Labor and I-140s are for the Employers and Employees take over only in the I-485 stage. So we need to strategize instead of doing wishfull thinking. Its lot usefull if we be analytical in these threads rather than pouring out emotions.

    Hi Gurus,
    Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.

    Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I can’t go for VISA stamping in India for Company B as I have not got my H1 Approval yet.

    Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?

    What all documents I have to carry to reenter safely?

    If u travel while H1 is pending then its deemed abandoned. U have to file for ur H1 again thru company B and start over the process. Rather I suggest you to convert it into premium and get the approval before you leave.

    I got a RFE on my 485 on 11th April and I have responded to it. By next week it would be 60 days by which USCIS has to take some decision. What would be the status update as my PD is Aug 2006.

    Is it normal to get RFE while PD is not current?
