Again, the bulletin mentioned beginning July 2. Every day, any day, starts at 12:01 AM. July 2 is no exception.
I Feel that what USCIS will do next is not return any application back to sender but DUMP them in some backlog storage room like BEC center and people hAVE TO WAIT FOR NEXT YEAR VB in OCTOBER IN ORDER TO GET RECEIPT NUMBER BASED ON PD AND THEN THEY WILL GET EAD and AP. The only thing is one might save on INCREASE 485 FEES:eek:

All I hear is "incorrect", "wrong" followed by individual interpretation or opinion. I respect all disagreement part, Which may be/not be accurate. Why don't you quantify your comments with references to law or CIS memo? Don't you think discussion need to be healthy and fair?

I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?
No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.
India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

It happened because of relentless canvasing of the media until the story got out and embarrassed the government. "Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.
I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.
The next phase is to focus on legal options.

Well majority of the people on this thread and forum is finding this as just cause, I am totally for it.
However no one is sure if this logic will hold water. Well none of us are lawyers, thus our arguments for or against doesn't hold. Someone said at the start of this thread that let's consult some big lawyers.
People are ready to contribute (including me) and I personally think that IV Core will be the best forum to take this up with lawyers. They already have an existing network, have folks that have participated in efforts related to legal immigration,

I have pretty much the same story and am in pretty much the same situation due to PBEC and now retrogression.
I don't think returning back as a knee jerk reaction is a good idea. If you have already been here 8-9 years obviously you have been stuck in a programming job for the last 10+ years. You can't take programming experience back to home country and ask for management position. You will get no programming position because you are over qualified and no management position because you don't have the experience.
However horrible it sounds, its best to stick it out. I am personally ready to stick it out for at least 1.5 years. After that I will be forced to make a decision otherwise I will lose my canadian PR also.
Let's talk about three things:
1. Make efforts to get GC.
2. Plan for your future: Enhance your education, apply for PR in another developed country.
3. Make your present better: Enjoy everyday, don't worry about GC.
I was thinking about PMI, CISA and MBA right from the time I landed in US in 1999. Then I realized that I need to get an GC to make use of those. Then I started to look for a stable company where I can start my GC process. It took three years toll till then. I joined a good ameican company as a perm employee. They did not file my GC as they promised and I had to quit to join another company for the heck of my GC and for my (my wife with CPA / CA is on H4 for 5th year now) dream career. I had to go many step back in technology with the new company but I sucessfully managed to file my GC.
Then what? When I finished studying my PMI, all the retrogression story started. Then I had to ask questions my self.
1. With PMI certification in 2004, if I am doing a Sr. Software engineer, will it not raise questions down the line in my career interviews. May be yes or no, but I do not have answers.
2. With PMI Cert in 2004, if I can get my GC in 2005, I am pretty sure I could manage any questions throws at me, but not in 2008 or 2010. So I dropped the idea on PMI / CISA/ GMAT until I have 50% certanity of when I will be getting my GC in hand.
3. The worst will be starting an MBA with good univeristy and competing it in next two years with zero hope of getting GC then. What would you do if you are not even closer to file your 485 when you have MBA degree in hand. You will have career in your home country with this MBA for sure, but who will pay your debts here. It is like shooting yourself on your foot with golden gun. Atleast you will be satsifed it is golden gun, but the end result is hurting yourselves.
4. So what is the option? Never give up. There are always difficult times for everyone. What we are facing is nothing. There are people who are graduating at the age of 70 in US. I have seen a lady at the age of 70 graduating with MAB from Harvard. I thought she did it for fun, but in an interview she said she wants to pursue her career in marketing field. This is an eye opener for me. So prepare yourself with TOEFL and GMAT. These scores are valid for 5 years. Join from volunteer organizations and develop your leadership skills. Reco letters from these orgs will have great impact when you apply for MBA infuture. Most of all it is right way to live a peaceful life atleast if you do not go the MBA route, you will develop the skills needed for your life.

You could have called the local finger print office, and asked to move to another day because of travel. They let me come in 2 weeks early because of a flight. I had tickets in hand but they didn't ask to see.

I have just called the USCIS. They told me that the applications will not be rejected but just put on hold until our visa numbers will be avialiable ifor the nerw FY 2008.
In addition she told me that the Nebraska office is sending back the filing receipt to the applicants which it should not affect our h1-b visa status in case we are going to travel.
For the last part I do not believe her. Is there anyone else that can confirm that ?

Nurses are already under shortage occupation list, even though some articles says otherwise! Their visas stopped from Ja. 2007. US hospitals will definitley feel the heat within months, since, much awaited their nurses are on hold at their parent country. US Hospitals have already invested funds for their CGFNS, RN. petitoning etc. Their emergency rooms will be overcrowded.. and wards will be shut down.. if visas not approved soon. .. Senators have always soft corner in health industry.. and they will not allow public to feel the heat..Blocking nurses visa will definitely put us in bad picture before the american public..

I have not received my stimulus check yet. Here are the details:
Paper filed the tax returns early February.
Opted for direct deposit in the checking account.
Last 2 of social security are between 39-50
According to the following link http://www.irs.gov/irs/article/0,,id=180250,00.html, I should have received it by now.
I am wondering if some one else is in the same boat & has called the Rebate Hotline at 1-866-234-2942.
