    Becoming aware of what is holding back is what I am trying to achieve. When you have such awareness, you also have the ability to change.

    The proof of the pudding is in eating. I beleive we have stopped HLGs and others from stealing unused EB3 visas exclusively for one retrogressed category.

    We are not asking for too much and I think IV can make it happen fairly easily.

    WASHINGTON -- Greeley Mayor Tom Selders wants to know when Congress is going to address immigration reform.

    It's a simple question, but the answer is as elusive as the proverbial dog's tail -- a dizzying chase of vague answers and insufficient information.

    "It seems to me like people are talking about immigration issues all over the country," Selders said. "I think that it is really sad that the government can't put a priority on it."

    The latest source of Selders' frustration was a meeting of business and community leaders in late January with Sen. Wayne Allard, R-Colo.

    "We were disappointed with Allard's response," Selders said.

    Sean Conway, Allard's chief of staff, said Allard never promised to bring up immigration at this particular delegation meeting.

    "What he talked about was that he would be glad, as the process began to move forward and as concerns were brought forth, to pass those concerns on" to the delegation, Conway said.

    Conway said Allard would very much like to see the issue brought up in the Senate, but that as far as he knew, it was not at the top of the Democratic agenda. "This is an issue (Allard) very much wants to be involved with and has been involved with," Conway said.

    But Sen. Ken Salazar, D-Colo., said immigration was a major issue that would be addressed this year, maybe as early as March.

    "I think it is just a matter of time as to when we are able to get to it and I hope it is sooner than later," he said. Salazar is working with the Senate leadership on the immigration legislation, which will be sponsored by Sen. Ted Kennedy, D-Mass., and Majority Leader Sen. Harry Reid, D-Nev.

    But for Selders, soon is not quick enough.

    "We have frustration here. We see a lot issues and turmoil and some very nasty comments," he said. "(City officials) have all taken oaths of allegiance we will enforce the laws of this land and the frustration is that we lack the resources to do that. The laws are unclear and we lack jurisdiction."

    Immigration's National Outlook: Cloudy

    Outside of the Colorado delegation, consensus and clarity on when the immigration will receive top billing by Congress is not much better.

    Congress, under Democratic control, is actually in tune with President Bush on immigration for the first time in years. Despite this, few observers believe that a comprehensive immigration bill will pass this year.

    One of the few is Bob Dane, press secretary for the Federation for American Immigration Reform, who said President Bush and the Democrats were "locked and loaded" to pass immigration reform that included a guest worker program, or "amnesty."

    "I don't see how immigration can be an issue leading up to the 2008 election," he said. "It's such a volatile issue. We are guessing that they want to get it done before the election."

    But John Keeley, director of communications for the Center for Immigration Studies, a think-tank that researches immigration, was not certain. He said many of the freshman democrats, known as "Blue Dogs," who gave the Democrats the majority, were elected on immigration platforms that were against a guest worker program, favored by Bush and the Democratic leadership of Congress.

    "On the horizon of the 2008 general election we tend to think that it is not likely we will see significant legislation," as opposed to last year, he said.

    Keeley said instead of landmark legislation, lawmakers will try to pass bills or amendments that only address small pieces of the issue.

    That process has already begun. A bill was introduced in the Senate that would set up a guest worker program just for agriculture workers. In addition, a provision has been attached to minimum wage legislation that would withhold federal contracts from any company found hiring illegal immigrants.

    But the Democratic leadership is hoping to have a comprehensive immigration bill on President Bush's desk by the end of the year.

    Laura Capps, a spokeswoman for Sen. Ted Kennedy, D-Mass., said the senator, who is the Senate subcommittee chair on immigration, border security and citizenship, was hoping to have the Senate bill introduced in late February or early March. Capps did not know of an exact date yet.

    The real fight is expected in the House, not the Senate, which passed bipartisan legislation last session. The Republican House leadership was uninterested in the guest worker program, however, and only discussed the border enforcement aspect --the so-called 700-mile border fence.

    Rep. Zoe Lofgren, D-Calif., the chairwoman of the House subcommittee on immigration, border security and claims, plans to begin the committee process "promptly." But her spokeswoman, Kyra Jennings, said no date has been set to begin consideration of an actual bill.

    Most states focused on education, employment, identification and driver's licenses, law enforcement, legal services, public benefits, trafficking and voting procedures.

    The following are your words, aren't they? I am not sure how anyone could read this anything other than a suggestion that people in ROW category are unskilled and a worker from a oversubscribed country is skilled. You may be the most skilled, intelligent and smart person around here but rest of us can at least read and gather what you are trying to say.

    I have nothing against you but I wouldn't want people calling ROW folks unskilled. I know you were talking about EB3 ROW but there are ton of engineers, software designers, and many more who applied in EB3 (some by skill sets, some by force, and some by choice). They are not unskilled people by any stretch of imagination.

    Now thats unfair .... you are just using one part of the quote to distort the entire post ... The discussion and context of that statement was always on categories.... and was using that sentence as an example on categories...
    The assumption was that readers would understand categories over individual qualifications/countries of origin in this context

    If you destroy the context in which a statement is made it makes the entire post "look" bad and is disingenuous

    You didn't specify if it has been 6 months since you had 140 approved through company A. Assuming it has been over 6 months (so company A won't revoke your 140), you can file for 485 and use the LC+140 of company A. You do not need an H-1 with company A as employment based GC is for future job not present job. The only risk involved is, if you apply for 485 which you are employed by company B, and if you get approval within 180 days (which I highly doubt) then you HAVE to go and work for company A for 90 days. If nothing happens for 180 days, you are safe.

    Hope this answers your question. Anyone, correct me if I am wrong.

    IV hasn't spared any efforts in attracting other Immigrants and making them comfortable in a forum with overwhelmingly high Indian members [the reality]. Like the ban on vernacular language usage on the boards, statements and posts giving a distinct Indian feel to the forum etc. And yet 98% (may be more) of those who marched on Sep 18th were Indians.

    When the participation is voluntary, I fail to understand the issue of concerns over the participation of one community and the absence of others. Of course the most active protesters will always be the hardest hit.

    For example, Civil Rights movement was predominantly African-American as they were the hardest hit by segregation. Ditto for the marches by Undocumented immigrants, which are predominantly Hispanic. Though it's estimated that there are around a million Indian illegals, there's hardly any Indian representation - thank God for that - at their rallies.

    We should stop worrying about the ethnicity of the participants and concentrate on the issues at hand, which are affecting all ethnicities.

    they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities

    They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

    I share your Pain, but I must congratulate you on receipt of your RENEWD EAD.

    My case, I am planning a trip to INDIA, but still waiting for EAD to be received

    i think it's not quite that simple.
    there is no doubt that lack of numbers is a key key issue. but letting uscis off the hook when they have failed to process 269,000 Green Card numbers since 1994 is not kosher. that is >20% of the backlog right there.


    Sigh... it's never simple...

    That said, NC can account for nearly all of the wastage. Think about it, let's say the processing time is 120 days (well within target, and not at all bad for a government agency).

    OK; recall that you can't apply until your PD is current (read this sentence again, this is a critical element of the problem).

    Application #1 (made in first half of year, visa tentatively assigned from current allotment year) -> PD current, goes into NC.

    Application #2 (can't be made in first half of year, because PD is not current, visa is not "tentatively" assigned from current allotment year, since it isn't expected to complete within the allotment year) -> PD becomes current in July, NC happens quickly.

    Application #2 takes 120 days to process (better than target), but that means that (as expected) it isn't ready to be assigned a visa until after the next allotment year (so far so good, USCIS has accounted for this, and doesn't expect it to consume a visa from the current allotment year).

    So application #1 couldn't consume a visa because of NC, and application #2 fell into the normal processing time, but this pushed it into the next allotment year (again, this is expected).

    Early in the next allotment year Application #2 is approved, and consumes one visa from the next allotment year.

    Application #1 is where the actual wastage occurs, since it is expected that an application filed in the first half of the current allotment year will consume it's visa within the year (and given USCIS processing time it would have, but it was stuck in NC).

    So at any time, the USCIS is processing applications within their target processing times, but because of the fact that you can't file until your PD is current, the applications that would have been able to have consumed the visas that were not consumed due to NC delays, couldn't because their "normal" processing time put them into the next allotment period.

    So why not let people apply before their PD is current then?

    The reason USCIS doesn't let you apply before the PD is current is because there aren't enough visas and they would currently have ~3M applications in process, many of which would be abandoned prior to approval (due to the long delays, caused by lack of visas).

    So, because of the insufficient numbers of visas, USCIS has determined that it is more efficient to restrict application until the PD is current; thus insuring that most of the applications that are going to be abandoned, are abandoned before they are filed (therefore reducing load on the USCIS). This seems like quite a logical decision given the constraints.

    I am willing to bet, that the net result is that the USCIS can actually approve more 485's in an allotment year by wasting some of them at the end of the year (which occurs primarily as a result of the fact that USCIS can neither predict, nor influence NC duration), rather than dealing with the huge inefficiencies of having millions of applications on file (which would, however, insure that there were sufficient processed applications to consume all visas).

    If either NC were predictable (and quick) or there were sufficient visas in each allotment period to meet demand, then there would be no wastage. You can beat on USCIS all you want, but they simply cannot control either of these factors...

    Like I said... it is never simple...

    Now, this thought is hardly original (I think that everyone who has looked at this problem comes to the same conclusion), but I think the most practical solution that we (as customers of the system) can suggest, that will provide partial relief (and has some chance of happening in our lifetimes); is to get congress to pass an amendment for automatic reclamation of visas from prior allotment periods. This would mitigate the problem of visa wastage, as this will allow a substantial portion of what would have been wasted visas, to be consumed by the applications who's PD became current in the second half of the allotment year, but could not be processed (due to normal processing time) prior to the end of the allotment year. Perhaps this reclamation could be restricted to applications filed in the allotment period from which the visas are being reclaimed (if this somehow made it more palatable to congress).

    Of course, this does nothing to solve the problem for those individuals stuck in NC who are effectively "donating" their visa to individuals who aren't stuck in NC. Perhaps they will feel better (I seriously doubt it though) knowing that the visa that they didn't get this year, was not wasted...


    my straightforward NIW application based on national interest service not exceptional ability (which may be more subjective) will take almost a year to process. wow....!


    In Canada this would be expected to take 8 months to process. Like I said, the USCIS is quick relative to other bureaucracies...


    uscis also takes the narrowest interpretations of any law- even when it clearly conflicts with the law's intent- then it takes a lawsuit to budge them- speaking from personal experience and the loss of 4 years in PD in an India line...believe me this is not an agency i feel like defending.

    This isn't about defending or attacking USCIS, it is about determining the root cause of the problem, and doing that requires an emotionless analysis of the facts.

    I have had IO's who were complete dorks (refused to admit me with a perfectly valid visa), but really, what impact does one dork IO have on the big picture? Absolutely nothing I suspect (and to be fair, the vast majority of IO's that I have dealt with have been very decent human beings).

    I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

    That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.

    I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!

    But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

    Here is how I made up my mind to go to the Rally.Most of us waited for an average of at least 3 years in my case, this is my 10th year waiting to get a Green Card after two failed attempts of starting the process and changing employers in 1999 and 2000 and counting. All of us really don't know how many more years do we need to wait and getting extensions every year, either for your visa or for your travel Parole, or your EAD. Most of us are tracking our receipts now, why, because we don't have a transparent system, did you get an LUD, Did you get a FP notice how come I did not get one, where is my application, did your application get to TSC, was it transferred to NSC, what did your lawyer tell you, why did my lawyer tell me this way.

    Why are we all passionately managing and exchanging so much information, because we have no clue what is happening behind the scenes. All of us know there are a very few who will get a green card tomorrow, but for most of us, we keep tracking to see anything in the change of status. Feeling uncertain is not a good feeling, I felt it for the last 6 years. How long will an employer wait patiently for you, how long will your wife wait to see she can work, how long will your in-laws respect you when you said during marriage, oh she will be able to work very soon:), how long will you keep convincing yourself, everything will be fine if I just sit and do nothing?
    THAT IS WHY I SHOWED UP, THE SENSE OF SATISFACTION IS IMMENSE TO STAND UP AND PETITION. TO MEET LIKE MINDED PEOPLE WHO HAVE UNDERSTOOD THAT DOING NOTHING IS NOT AN OPTION!

    But the feeling of "being uncertain" made me go. The excitement that I could meet so many many of you who work selflessly and volunteer so much of your time was priceless.

    When we finally reached there, we saw moms, who had kids volunteering, sometimes we had babies, kids in the situation room helping mom organize things, we had people drive from far places, leaving kids in neighbors/baby sitters home and had to drive back late night for 2 3 hours to get back to them. We had people hit the bed at 4 am in the morning and show up the next day all suited up and ready to meet lawmakers at 7 am. That made our trip look so simple!

    Guys we respect everyone's reasons, yes we do have lots of genuine reasons and it is not for me to judge personal reasons on how important they are. The point I am trying to make is purely this, think it through and see how you life was or will get affected by this process. Many of you filed your 485 and are instantly gratified that things are fine. I can't stress enough that this is not the case. When I got to file in June I was very excited, I used to see LUDs, FP, got EAD, Travel Parole and everything and then nothing happened. It stays there and from all the statistics, numbers and logic that we all apply, it will stay that way for years. If you think you are out of the woods, think again, all it did was from one stage of the clog, now we are clogged to the other stage of clog. If you think you are now easy to move around, change your jobs, think again. It is extremely complicated with no guarantees that the USCIS officer will interpret your job duties that same way!

    Sometimes during discussions we all think, what is it that is stopping you all to come, sometimes after working so hard there does happen a feeling, what reason is big enough for them to not show up, when we did. So please don't get offended either way, we want all of you, we want everyones support and keeping egos asides, lets think how best can we speak in one Voice! Lets all be involved with IV activities, action items and work on it passionately. Remember each of your voice makes Immigration Voice stronger and be heard better!!!

    they were not formed at the last moment in most cases
    what makes you think people participate in those? from personal experience
    in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
    ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

    We had similar experiences in New England too!

    Not to mention cases where people that promised to come didn't show up. In two cases, we had people who didn't even answer their phone calls or reply to voicemails while we were waiting to pick them up from the pickup points! That is just unforgivable! One of these "people" were supposed to be part of our Lobby team!
