I agree that porting to EB2 is the best route. But my company was very reluctant to file another labor to port my case to EB2. They thought thur PERM, they may have to hire some applicant if they meet the requirements. The lawyer thinks PERM is risky. I know they are trying to avoid EB2 labor at any cost, though I also know a few friends who had the PERM labor application recently rejected.
Anyway, bottom line for me and others in the same situation is that we are stuck with EB3. And maybe stuck in the rut for a long long time unless something magical happens....

This year with overflows from ROW category, maybe 40K extra numbers were used for backlog reduction. Adding 10k for each china and India it makes the number 60K. Isnt 90K better than 60k (if we are lucky) under current system?

you are half right, the country quota laws were put much earlier than the off shoring companies, but remember that the retrogression only started in the last 10 years when those companies came in the picture and skewed the lines .. that's ur cause and effect!

And besides these companies are all software cos that came up in the last 10 yrs, why should that stupid rule affect any person in a non-software field?
Yes we know that the current rules make the journey longer. The point is that it is unfair and that's why we should start trying to change it!

It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

I am not sure if it is only me.....but many times I see strangers wishing me or each other morning, evening...."how u doing" ,,,etc....
but Indians (I am also an Indian -:) are a little reserved....I do not see a greeting from fellow Indians that easily.....again I am not saying Indians are bad (cause I too am one -;)
maybe it is a culture thing for us not to greet strangers ?
PS - I have had my share of experience where non-Indians are also sometime rude me to me .....

I did not go to DC because i did not want to get the green card this way.I grew upwatching aunts,uncles coming from USA bearing gifts.I grew up watching cousins go for USA for higher studies.It used to be so special. Now its become so cheap. Now you guys have literally taken it to the streets. There's no difference between those illegal immigrants and us. Prince charming - I invoked AC21 sometime back after 180 days of filing 485 and moved to a new job on EAD.
My ex employer revoked 140. At this point of time I did a lot of research and found out the following things
(1) AC21 letter never reaches your file - there is no system in place for AC21 letter. G 28 gets into the system because there is a process in place for G 28
AC21 is a law that allows you to change jobs but there is no system in place.
(2) AC21 letter must be provided upon request - different officers want differtent information so they generally issue a NOID and ask you to submit evidence in 30 days. USCIS in some cases sends out straight denials. The denial letter generally has information to file MTR within 30 days if the case needs to be reopened due to USCIS error.
In August when my case was being processed, they sent me a NOID but sent my wife Fp notice - I called customer service and was advised that she can go for FP as usual but I have to respond to NOID before they move forward with my case and I promptly responded with AC21 and my case status changed to "Case reopened, response received" and there were soft LUDs hitting my 485.
Keep all documentation ready and be proactive, you can hire a good lawyer from MTR, remember that when you file for MTR, you cannot work - so before you inform your employer, get a letter from them and then inform them - in case employers will be reluctant to give any documentation if they know you cannot work for sometime. If you are on h1b you dont have to worry.
MTR approvals can take 3 to 5 weeks or more too.
if not on h1b you start accruing unlawful status and usually lawyers suggest that you stay till less than 180 days when your MTR is filed - it never takes 180 days for a decision on MTR so dont worry about unlawful status.
These are hidden risks in AC21 but good news is that AC21 cases have always been successful.
You may have to go through this period of uncertainity.

Here are just a few that I can think of rightaway.

2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!
