Looks like the French felt like Indians are 3rd world country people and thats how they treated them. Reality is France is the newest third world country. While there are less slums in India now than 10 years ago, it's the opposite in France. They have more slums than ever and their work culture is pathetic. 35 work hours/week, 3 months vacation, endless sick days and no one can get fired. all they do is complain, riot in the streets, burn cars in suburbs. The Champs-�lys�es type of fancy France is only 10% and the remaining 90% is a sh*t-hole.

Not necessarily getGC. I am EB3 but i am a Masters from the US. Sometimes for fresh hires lawyers play it safe by applying in EB3. I had emailed someone at competeamerica.com and they had mentioned that an "advanced degree" is either a masters or a PhD. You mentioned that you had an engineering degree from India. Is that a B.E. or an M.Tech/M.E.? If you have a master's degree from India, you need to ask ur lawyer if that qualifies as an advanced degree.
But even otherwise, it still benefits you, coz say even 20-25% of Current EB3 have master's degrees, they will be out of the queue and you will be benefitted. I know it doesnt sound like a benefit, coz it is not a direct one, but if you look at it from a different angle, you will see it.

Yes, a plumber occupation would not qualify as a Highly Skilled occupation, it isn't on the list of in demand occupations. So - are you EB3 category? You need at least a 3 year degree for that (or if you don't have a degree, you need 3 years of experience for each year missing - so 9 years experience - depending on your unspecified "equivalent qualifications" - NVQ may or may not count, but I'm only guessing that this is what you have)
If you've been waiting 2 years, you have roughly 4 more years to wait imo, but to be honest, based on the info i have, I have doubts whether it would be feasible. If you can't get an H1B because your job wasn't applicable, getting an EB green card will be very tough.
I think he already cleared LC and I-140 and his case is at the stage of consular processing. Unless the consulate has the authority to question his qualification for an EB3 visa he may get his IV as soon as his PD becomes current.

Shows you the general herd mentality on this forum. As long as everyone is thinking the same way, everything is great. If you differ, everyone will call for a ban on you. They are all lemmings. Unfortunately, I had to come to this forum for news. I have never seen such a bunch of dimwitted people in one place...
None has called a ban for anyone being differ but it's just the way you express your opinions by using the words like "herd mentality", "dimwitted" etc. Not that you have accepted that you are here for news only, I don't think we need people like you.
IV is not a news site. It's a group of people who are fighting for a common cause. One needs to understand the common cause is not just helping July filers or people affected with retrogress but a bigger aim of helping all the legal employment-based immigrants. But one also needs to understand that not all the objective can be accomplished at a time and we need to strike the iron when it's hot and make every opportunity count, be it a BEC, retrogression, July filer or Visa recapturing.
Having said that, I do agree that BEC is one of the issue which should definitely be focussing on next. I'm sure IV members (even if they are not a BEC victim) will support whole heartedly any cause which can bring some relief to BEC victms. What we need is a united front and some unique ideas like flower campaign. Do not forget the flower campaign idea was pursued by one of the IV member who was not part of core.

Agree with you 100%. I have been waiting patiently all along hoping something good would happen for EB3. I am talking to my employer if they can port my case to EB2. I have a master's degree and about 13 years of experience (8 years in the current job). My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?
If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.

The intent of this thread is good. There are however practical considerations.
Many of us are from India. In the era pre opening up its economy, we had many well educated folks unable to get jobs there. The socialist strangle was such that highly educated people had no suitable jobs and private enterprise was actively discouraged. Many sought economic and professional refuge in more capitalist economies and to some extent we are still seeing the spillover from the policies of that era, with an excess supply of human skilled capital there and opportunities still not able to spread to the whole economy/population.
The reason I am saying all this is, investing in skills like masters etc is generally a good thing, but not always. In fact there are many studies to prove this point, some demonstrate that too much education is a negative predictor of economic success.
In our situation, capital is important, whereever we end up. Since in a capitalist model money works for you, and obviously if you have enough of it then you can spend your time doing other things, charity work or whatever warms your heart. Doing an MBA or any other higher education is very expensive in america. It is an investment. If you end up here, it will perhaps turn out to be a good investment, otherwise it will be of limited use to us especially in India, especially if a global recession hits.
Pessimistic you say, lets reserve judgement on that and consider all of the geo political issues going on right now.
If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.

I disagree. I would expect a person to convey that they are not officially open despite the doors being open. I agree its not nice on customers part to enter before the office is officially open, but that does not mean the officer just threatens a countryman.
We should learn to respect our countrymen/women first. If I were to try to enter a business which is closed but doors are open, I can tell that someone would tell me that same verbally!
You are correct - the Consulate official should have been firm, but polite. However, this does not excuse the person who tried to enter the Consulate before it officially opened. This is not your run-of-the-mill business establishment, but a government office / establishment with significant security concerns. Why don't you go to a federal building or a courthouse, or say, to the airport, and walk through a security checkpoint without listening to the instructions of the officers nearby, and see what happens. Maybe other people have tried this before, and the Consul official lost his cool on the day your were present. Again, this does not excuse his/her behaviour, but I wouldn't damn him/her for this.
In addition, at these government offices, the officials have to deal with people who demand 100% positive attitude while offering little in return. Read some of the responses on this thread: would you like to attend to their concerns on a daily basis?

Having time off with my boss is traumatic to say the least. I am entitled to seven weeks vacation a year and barely get three most of the time. Even when I am off I get phone calls and have to leave contact numbers, that includes when I am with my parents in England.
Can you imagine asking for two days off to go to an immigration rally that just reminds him that I will be out of his employment jail some time in the not too distant future I hope.
My green card process is in its sixth year. Look forward to shaking off my shackles and moving on with life. Glad to say my husband now has an EAD so at least he is free to work and join the human race again.
I am sure many people are in this sort of situation since we are indebted to our employers which is one of the things we would like to change.

I hear some people saying childish things like hijacking this thread if anybody says anything different from what they say. Please tolerate others views then they will tolerate yours.
Without strengthening AC21 if you allow everyone to file AOS then anti eb folks like Grassley, Sanders, Sessions, Durbin will move from targeting H1b to targeting EAD. It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.
Prefiling should be done to give relief to people who missed July fiasco only after
1. Remove\dilute same similar job requirement
2. Make sure EAD is extended without any rfe. USCIS will invent thousand things to issue rfe, EAD should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example Pay stub rfe, ability to pay rfe, customer Purchase order RFE etc etc etc, Green card holders don’t have any problem working in these same jobs so why should EAD people face this nonsense (otherwise it is just like h1). Before people complain this will become like a green card, lets me answer in advance, if a person from ROW can get his green card within 12 months of coming to US, why cannot people from India\china who have worked in US for the last 5 to 10 years get the above mentioned relief on EAD. EAD should be superior to h1.the only restriction should be you should work in the same field, i.e. if your labor certification is for Software engineer, programmer analyst etc , then you work in a software related job and cannot become a greeter in walmart :-)

Safeguards have to be put in place for order of priority date otherwise USCIS will indulge in this lottery mode and excuse there behavior by claiming they did this to save visa wastage.
