Are you kidding me? You are recommending http://www.usabal.com/ aka Berry, Appleman & Leiden LLP? DO NOT USE THIS LAW FIRM. RUN AWAY FROM IT AS FAST AS YOU CAN. They totally screwed up my case. My PD became current on June. I asked them repeadtly to file my 485. And I asked them for like 1 1/2 month. But they waited till July to file my case. So, I was affected by this visa fiasco. Their lawyer do not answer phone calls, they don't return voic mail and they do not response to email for 3-4 days. It is a totally BS firm. If possible go with small immigration law firm.
I agree. My case was approved online in early June, I kept asking them if they received papers from BEC, and they would not even take the time to check. As a result, I was unable to file in June even with a current PD. I ended up filing in July.

One of my friend is currently working for a company A. He has got offer from a reputed university and is interested in transferring his H1. The question is,
1> can he transfer his H1 from a 'for-profit' to a 'non-profit'?
2> In future if he decided to work again for a 'for-profit', can he transfer his H1 from 'non-profit' to 'for-profit' without being counted against the cap?
Gurus please share your knowledge on this.

I was also put into "EB3-India" forcibly by my employer - they love to see me chained , you know !!
The only future i see for EB3 India folks is charge your EAD and do "W2 Consulting" or "1099-Consulting" and make money...... Dont worry about "future employment letters" or that "last minute RFE"... That RFE is not going to come before another 5-6 years at least. If by chance your time comes , then get a permanent Job and get a "future employment letter " from them.
The whole thing that i wrote above is absolutely legal. As long as you stayed with original GC sponsor for 180 days+ after 485 application and had intention to be with them ( that time 5-6 yrs back) had you got GC - You should be GOOD...
Get it going folks - that's our future :)

I agree with you 100%. As this is true, lawmakers are very well aware of our grief, but none of them is saying it. They want to oppose legals in the name of opposing illegal immigration bills. If you look at CIR in 2006. First they put legals in the bill with illegals, then they oppose illegals, ultimately the result is no legal immigartion too. Nothing is getting passed in the congress for the legal immigration. what does it tell ?

This post does clarify visa recapture issues, but what about concurrent 140/485 filing ? Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?

I think lot of people feeling that it is very difficult to pass Senate version CIR(May be they will pass house version now and Senate version later).
That might be reason for Skil bill. But any bill which has permanent increase in immigration will face a big opposition and delay of few weeks to few months to pass. In past 2000 the h1 increase to 195k was passed because that was temporary and eventually Cap was back to 65k. Similarly for GC unused other country quota was used to India and China. So everyone got a relief without much oppostion. Beacuse they were able to convince all congress members that no change in Cap of immigration. I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.

I recently switched employers using AC21 and am using my EAD to work for the new employer.
I used to be on the H-1B visa when I was working for the old employer, they had applied for renewal just before I left, and it got approved right around that time. Now that I don't work for them anymore, they are having the H-1B revoked. Of course, they were kind/professional enough to intimate me of this before doing so.
I am wondering if this could have any adverse effect on my 485, or if it could provoke an RFE? Any thoughts/stories would be appreciated.
